Germain Fitch ture story

Well, to shed some light on this whole situation, i am going to tell you that Germain truly did nothing wrong....I talked to him the other day and got the full story. Germain was driving another person's car (not another athletes) Germain was asked by this person to bring them home from the bar on monday night. He picked up the car and drove the owner of the car home. Fitch then drove this persons car home because he needed to get home. Fitch was playing with his phone, (sideKick i beleive he called it, a flip phone that has a keyboard thingy on it) when he was pulled over. The cop cited him and smelt the weed. Fitch having not smoked or not know the weed was in the car let the officer search the car. So the truth of the matter is fitch got in to trouble for helping out a friend. The cop said that he was in possesion of the car which meant he was in possesion of the weed. I hope that this will help, i am a good friend of fitch and he understands that the situation is embarrising but he truly did nothing wrong but be in the wrong place at the wrong time

I hope you're right. I want to believe this story... I really do! Again, the hope for THIS truth is the whole reason I tried to keep the story quiet on here as long as I could.

Personally, I believe this... people might accuse me of wearing orange-colored glasses, but I really had a feeling Germain was in the right the whole time... gut feeling kind of thing.

Don't know "NoItALL2" from Adam...

C'mon take off your orange colored glasses. You know as well as I do that Germain is hoping to pursue a career in the future cheech & chong movies! ;)

Messin with your sidekick thingy while driving is wrong. Especially one of those with a thousand buttons on it. If your story is accurate, Fitch wouldn't have got in trouble if he just could have kept his thingy in his pants. :o

Not bad, Warthog... not bad. ;-)

Also, Germain DID drive w/o a license... so the fact that he "truly did nothing wrong" could be disputed...

The only "hole" I see in the story is something to the effect of letting the cop search the car b/c Germain didn't know there was weed in the car. I don't care how distracting sidekicks or cell phones may be . . . he HAD to have known there was weed in the car or he was having a REALLY interesting chat on the sidekick! :wink:

How would he HAVE to know? If the owner doesn't tell him, its not like he'd think to search the car in the event there might be something illegal. Would you?

If you believe the cop's story that there was the odor of burnt marijuana, you'd have to assume Fitch knew it was in the car.

I wouldn't rule out the possibility that the cop is lying about the smell of marijuana. Saying that he smelled a specific illegal drug would probably be enough to establish probable cause to search the vehicle and it's half-assed enough to be nearly impossible to disprove in court. The story buys him a fishing license and he managed to catch something.

That's exactly what I was thinking Flipper. I not a big fan of smoking myself, I've actually never tried, but I've been around many who have and the smell is always quite obvious.

You make some great points here.

It's possible that the m.j. smell is deep into the fabric of the car and the odor gushed out of the window with GF opened the window for the officer.
