Designing a profitable enterprise around someone's likeness without their permission seems dodgy.
Sorry, it's exactly the same. They certainly cover more than mere "public events." And in this case, it is the *actual* athlete, not some video game mock-up with vague similarities.
Mr. Keller could very well not only destroy the EA franchise, but a great deal of media exposure that college athletes receive.
