Seriously, I gotta agree with Botox-this is a new wrinkle (yes) in the NCAA vs. athletes thing. Pictures in a magazine taken in a public setting are clearly different- you're no more protected in that setting than Paris Hilton on a night out.

Designing a profitable enterprise around someone's likeness without their permission seems dodgy.
How about complete networks designed to profit from the college game, ala "The Big Ten Network?"

Sorry, it's exactly the same. They certainly cover more than mere "public events." And in this case, it is the *actual* athlete, not some video game mock-up with vague similarities.

Mr. Keller could very well not only destroy the EA franchise, but a great deal of media exposure that college athletes receive.

It seems like a victory for the athletes would definitely be the end of media coverage of college athletics. Think about it. Are video games the only outlet making money off of college athletes? What about every game that is aired on ESPN, FSN, NBC, ABC and whatever else? Notre Dame's players should sue NBC and Notre Dame itself. Where would it end? Newspapers sell (sometimes) because of the coverage they give to college athletes. Are High School athletes next? Will they start filing lawsuits against radio stations that broadcast the games? This is a very slippery slope and I hope it gets straightened out before things like this happen.

This whole topic is stupid.

Students are not able to profit off their likeness. As it was said before, they agreed to that when they signed the letter of intent.

However, no one ever said other people can't profit? I have my favorite college player's jerseys. Someone is obviously making money off their likeness.

It's just another symptom of the American get rich or die trying legal system.

Not to mention, who the hell would want to play a college football game with completely made up players. It's like 'Blitz - the league.' Totally worthless.

Isn't "Blitz" like Madden meets that ESPN show "Playmakers?" Doesn't it have off the field stuff you can do too?
