But what was the joke? He couldn't really been having intercourse with her, could he? I mean, I don't have any buddies that let me **** their wives for a joke, do you?

=>It happens quite often. Particularly if the victim is drunk or otherwise incapacitated.

Yup. "IT" was only a joke. "IT". One side can say IT was one thing, and the other side might say IT was something completely different. That text message gets us nowhere. Do we even know that the text message referred to the alleged incident?

Again, until we have the facts, all that we're doing is moving around a lot of 0s and 1s.

=>Beyond the he said-she saids, there is only one part of anyone's story the police could objectively verify. If she said he texted that, she can back herself up and prove it my showing the police her phone. Besides that, there is nothing objective to back up her version or Goodsen's version (whatever that may be). The text message clearly supports her version of the facts that 1. she did not know it was not her boyfriend and 2. that her boyfriend was playing a joke on her.

Assuming the phone sez what she sez it sez, as far as scoring objective cooberative evidence (that is reported in the article anyway), it is Alleged Victim 1, Goodsen 0. The best Goodsen could do is explain away the text message as did mean some other joke (maybe with the help of his buddy/Alleged Victim's Boyfriend). But Goodsen cannot deny the existence of it.

If the rape kit shows Goodsen's DNA (particularly if it is sperm or skin found in fingernails of Alleged Victim), then that text message would be huge evidence to show it was a non-consensual (thus a rape under Ohio law). Why? If the boyfriend just found out his girlfriend had consensual sex with his friend, he would not have been apologizing to her shortly thereafter for playing some other kind of minor joke on her. Instead, the boyfriend would be a little p!ssed off at her and thus in no mood to apologize to her.

Boyfriend to self: "My girlfriend just cheated on me. I think I will text her to apologize for pulling her chair out from under her as she was sitting."

He said he entered the room, saw the couple having sex, and immediately left, only later to see the woman race from the apartment. He said he thought the woman was embarrassed and angry he walked in on her and her boyfriend.

If Goodson accidently walked in on the Alleged Victim and boyfriend having sex and then she raced out, what joke would boyfriend have been apologizing about? If Goodson's story is correct, what joke took place between the time he walked in on them until she raced out of the apartment shortly thereafter.

Goodson says he believes she was angry because he walked in on them. Since that was an accident per Goodsen, that could not be the joke that was referred to in the text. If she was mad about being walked in on, why was boyfriend apologizing for a joke instead of maybe "failing to lock the bedroom door."

I see a very limited window of time frame for the joke to have taken place.

I forgot to mention this before, but again, if Goodsen's sperm DNA is found on her with the Rape Kit, he is toast as it contradicts his story completely.
