Man Arraigned For Adulterating Engine Oil
A businessman, Cajethan Chike Muonagolu, was on Monday, arraigned before a Federal High Court, Lagos, for alleged dealing on adulterated engine oil.
The defendant alongside his company, Richbon Nigeria Limited, located at Plot 242, Apapa-Oshodi Expressway, Odo-Olowu Bus-Stop, were arraigned before Justice Saliu Saidu led-court on four count charge bordering on conspiracy, dealing in substandard products and failure to comply with conformity assessment programs.
The prosecutor, Mr. Olofindare Adeleke, a Senior State Counsel, informed the court that the defendant was arrested between December 12 and 13, 2013, at ASPAMDA Trade Fair Complex, Lagos-Badagry expressway, with the adulterated engine oil.
Olofindare specifically, told the court that the adulterated engine oil found with the defendant includes: 15, 000 Cartons and 60,00 pieces of Prime Plasma, Prime ATF and Stanley brand of Engine oil.
The prosecutor, also informed the court that apart from the adulterated engine oil found with the defendant, the defendant also failed to comply with the Standard Organization of Nigeria’s Conformity Assessment Program in dealing in engine oil.
He said the action of the defendant contravened Sections 3 (6) and 1 (18)(ii) of the Miscellaneous Offences Act, CAP M17, Laws of the Federation of Nigeria 2004. And Sections 26 of the Standard Organization of Nigeria and Sections Act, 2015.
Upon taken the defendant’s not guilty plea, the prosecutor pleaded with for a short date to enable him assemble Assembly his witness for the trial of the defendant.
However, counsel to the defendant, Dada Awoshika, informed the court that he had filed a bail application and same has been served on the defendant. He therefore urged the court to hear the bail application.
Responding, the prosecutor told the court he was being served with the application in court today and he needed time to study and response to the application.
Following the request of the counsel, Justice Saidu, while releasing the defendant to his counsel, adjourned the matter till April 11, for hearing of the defendant’s bail application.
Part of the charge against the defendant “that you Cajethan Chike Muonagolu (M) (adult) and Richbon Nigeria Limited of Plot 242, Oshodi Apapa Express Way, Odolowu Bus Stop, Lagos on or about 12/13 December 2018, while at ASPAMDA Trade Fair Complex, Lagos Badagry Expressway Lagos State within the jurisdiction of this Honourable Court did deal in adulterated/substandard engine oil for public consumption to wit:15,000 Cartons of Prime Plasma, me ATF and Stanley brand of Engine oil which did not comply with mandatory industrial standards as to marking criteria and thereby commit an offence punishable under Section 26 of Standards Organisation of Nigeria Act, 2015.
Another Charge reads: “that you Cajethan Chike Muonagolu (M) (adult) and Richborn Nigeria Limited of Plot 242, Oshodi Apapa Express Way, Odolowu Bus Stop, Lagos on or about 12 and 13 December 2018, while at ASPAMDA Trade Fair Complex, Lagos Badagry-Expressway Lagos State Lagos State within the jurisdiction of this Honourable Court did indulge in dealing in adulterated/substandard engine oil to wit: 15,000 Cartons and 60,00 pieces of Prime Plasma, Prime ATF and Stanley brand of Engine oil which is not of quality, substance nature or efficacy which the seller represented it to be and thereby commit an offence punishable under Section 1 (18)(ii) of the Miscellaneous Offences Act, CAP M17, Laws of the Federation of Nigeria 2004.”
